Two Hospitalized in Three-Vehicle Miami-Dade Accident

Earlier this month in Miami-Dade County, an accident between a BMW car, a minivan, and a Miami-Dade County bus sent two people to the hospital. According to a news report by NBC Miami, one of the two people who were hospitalized was a five-year-old girl.

Evidently, the BMW was stopped and waiting at a red light at the intersection of NE 135th St. and West Dixie Highway when it was rear-ended by the minivan. The force from the collision sent the BMW spinning into the intersection, where it collided with the side of the Miami-Dade County bus that was heading south on West Dixie Highway. When emergency crews responded to the scene, the roof of the BMW needed to be cut off before the occupants could be extracted.

The BMW had five people inside, two of whom were seriously injured and taken to the hospital for urgent care. The three others in the BMW suffered only minor injuries. The two people in the minivan also suffered minor injuries. No one on the bus was hurt. All three people in the back seat of the BMW were not wearing their seatbelts at the time of the accident.

Police are conducting an investigation into what happened and why the minivan slammed into the back of the BMW, causing the accident. At this point, it seems as though distracted driving may have played a role in the accident.

Distracted Driving Accidents in Southern Florida

While it is not yet certain how the accident described above was caused, it seems fair to assume at this point that the driver of the minivan was distracted at the time and inadvertently ran into the back of the stopped BMW. These kinds of distracted driving accidents happen every day in South Florida, and they can result in many serious injuries and deaths.

When a distracted driver causes a car accident that results in either serious injury or death, the plaintiff—whether that is the victim, or the family of a deceased victim—may be entitled to monetary damages based on the driver’s negligence in causing the accident. In order to recover, however, an accident victim or plaintiff must prove several things at trial:

  • That the defendant owed the accident victim a duty of care;
  • That the defendant violated that duty by some act or omission;
  • That the defendant’s actions were the proximate cause of the plaintiff’s injuries; and
  • That the accident victim suffered some kind of compensable damages.
