After being involved in a serious car accident, physical recovery is often first and foremost on an accident victim’s mind. However, even after the initial stages of physical recovery are complete, the lasting effects of serious trauma to the body are not likely to ever go away.

Whether an accident victim sustains such serious harm that they are left paralyzed, or they are one of the lucky ones and are only left with lingering pain, the fact is that the repercussions of a serious accident are something that must be dealt with for the rest of an accident victim’s life. It is for this reason that Florida does not cap the damages that can be recovered for an accident victim’s future care.

Potential Damages After a Florida Car Accident

There are several types of damages that are available to an injured Florida accident victim if he or she is able to substantiate a claim in a court of law. First, and most common, is compensation for medical expenses. This award may cover both past and future medical expenses, but it is not limited to doctor’s visits or necessary surgeries. In some cases, accident victims are able to recover the costs needed to retrofit their home so that it is more accommodating for someone with significant physical limitations. For example, wheelchair ramps and kitchen and bathroom remodeling may be necessary.

Anyone who has successfully completed a driver’s education course knows that driving while under the influence of drugs or alcohol is against the law and can result in the intoxicated driver facing criminal consequences. However, the drunk driver may also face additional liability through a civil lawsuit brought by anyone who was injured as a result of the driver’s decision to get behind the wheel while intoxicated. This may include other motorists or pedestrians on the road, and it may include passengers in the drunk driver’s vehicle as well.

Drunk Driving Liability in Florida Courts

As noted above, drunk drivers can face criminal as well as civil liability. Criminal liability is what most people are familiar with when it comes to the penalties of drunk driving. This can include punishments like jail time, fines, and probation. However, the civil liability that can arise after a drunk driving accident can be equally significant, especially when serious personal injury results.

Drunk driving accident victims who sustain serious bodily injury can bring a lawsuit against the drunk driver, seeking monetary compensation for their past medical expenses and future medical needs, as well as for non-economic damages such as pain and suffering. These verdicts can be substantial in cases in which long-term injuries occur that will require treatment throughout an accident victim’s life.

Earlier this month in Miami-Dade County, a Florida Highway Patrol ranger was killed when he was struck by an out-of-control dump truck. According to one local news report, the accident took place on the Florida Turnpike near Southwest 120th Street. The accident took place at around 12:30 in the afternoon.

According to one local news source, the accident occurred in the northbound lanes of the Turnpike, as the ranger was assisting the occupants of a Ford Mustang that had broken down. The ranger was standing in or near one of the northbound lanes of traffic, attempting to get drivers to slow down for the occupants of the Mustang. However, not long after he arrived on the scene, a dump truck traveling in the northbound lanes lost control of his brakes as he attempted to slow down.

The dump truck struck a nearby light pole and then came careening towards the ranger. Although the ranger attempted to get out of the way of the truck, he was unable to do so and was struck and killed by the force of the collision.

Earlier this month, a police officer was struck by a passing motorist as he was responding to an accident on the side of the highway. According to one local news report, the police officer was responding to an accident around 62nd Street on Interstate 95 around 4:30 on a Thursday morning.

After the officer was hit, he was immediately taken to Ryder Trauma Center and admitted with serious but non-life threatening injuries. He was released later on that day and described his injuries as getting a little “banged up.” At the time of the article’s publication, it is not clear whether the driver who struck the police officer will be facing any charges.

Florida’s “Move Over Law”

Police, firefighters, and other emergency responders put themselves at risk every day simply by doing their job. When they pull off the side of the highway to investigate a traffic violation or assist in the aftermath of an accident, they are mere feet from vehicles traveling at highway speeds. In fact, accidents occurring on the side of the highway have increased dramatically over the past several years. This increase has led the Florida legislature to pass what has become known as the “Move Over Law,” requiring motorists move over for emergency vehicles when they are pulled off on the side of the road.

Earlier this month, a 16-year-old boy was struck and killed by a motorist driving a Hyundai Sonata while he was skateboarding. According to one local news report, the accident took place at around 9 p.m. in the area of NW 12th Avenue and NW 108th Street.

Evidently, the driver was heading northbound as he approached a slow-moving vehicle ahead of him. As he approached, the driver decided to attempt to pass the slow-moving vehicle in the southbound lane of traffic. However, when he changed lanes to pass the other vehicle, he ended up striking the teen.

Rather than stopping to see if the teen he just hit needed any assistance, the driver sped away, fleeing the scene of the accident. It wasn’t until a few hours later that the driver turned himself in to police, telling them where they could find the vehicle and confessing to hitting the teen. Investigators told reporters that the driver was visibly upset as he was discussing the accident.

Earlier this week, two young teens were killed as they tried to help a friend push her disabled vehicle to safety on Pembroke Road in Miramar. According to one local news source, the two teens had been dating for a year and had recently discussed plans to get married.

Evidently, the fatal accident took place at around one in the morning near the west side of Interstate 75. Apparently, the two teens received a call from a friend whose SUV had broken down on the highway. Along with several others, the two teens helped push the disabled vehicle about 20 blocks before it was struck on the driver’s rear side by a passing vehicle.

The driver of that vehicle told police that she could not see the SUV until she was right behind it. Evidence from the accident scene suggests that the driver swerved in a last-minute attempt to avoid the collision. There are contradicting reports as to whether the SUV’s lights were on immediately prior to the accident. The teens pushing the vehicle claim the lights were on, and the woman who struck the vehicle claims they were not on. She also suggested that if they were on, perhaps the bodies of the teens pushing the vehicle covered them up. The road is otherwise dark and not lit with streetlights in that area.

Earlier this month, a Tamarac man was arrested and charged with vehicular homicide for his role in a fatal accident that claimed the life of his passenger. According to one local news source, the district attorney’s recent decision to file charges was after an eight-month investigation.

Evidently, the man was driving a black 2011 Hyundai Genesis Coupe with one passenger, a 21-year-old woman, when he lost control of the vehicle. Upon losing control, the car slid off the roadway and wrapped around a nearby utility pole. Both the driver and the passenger were trapped inside, where they remained until emergency responders were able to free them. After they were taken out of the vehicle, both were taken to the hospital. Sadly, the passenger was pronounced dead shortly after her arrival. The driver survived.

Police conducted a roadside sobriety check on the driver, who passed. However, police believed that there was more to the story and initiated an in-depth investigation as to the cause of the accident. As it turns out, evidence suggested that the vehicle was traveling 77 miles per hour in the moments preceding the accident. The speed limit on that stretch of road was 35 miles per hour.

Last week in southern Florida, one man was killed and two others were injured in a two-motorcycle accident that also involved a car. According to one local news report, the car attempted to stop but was unable to do so and struck one of the riders. The accident took place around four in the morning between Miami Gardens Drive and Ives Dairy Road.

Evidently, two motorcycles were riding side by side on I-95 South when they collided with each other. Both of the riders were thrown from their bikes and landed on the highway. A passing car attempted to avoid the collision, but it ran over some of the shrapnel from the wreck and then ran over one rider’s legs. That rider was later pronounced dead at the scene of the accident by emergency workers. The other rider sustained serious injuries and was admitted into Aventura Trauma Center in critical condition. He is expected to recover.

The cause of the fatal motorcycle accident is still under investigation. Charges have not been filed against any of the parties involved at this point, but that may change as the police conclude the investigation.

The driver of the car was taken to Broward Health North in Deerfield Beach with minor injuries and is expected to recover from his injuries. Towards the end of last month, a fatal accident in Pembroke Pines took the lives of two people and injured several others when a semi-truck pulled out in front of a Mitsubishi, causing a chain-reaction accident. According to one local news source, the accident occurred a bit before midnight in the southbound lanes of Interstate 75.

Evidently, a semi-truck loaded with a concrete barrier was pulling out of a construction site and onto the highway when it was hit by the Mitsubishi. The Mitsubishi slid under the truck, ripping off the roof of the car. After the initial collision, a BMW crashed into the back of the disabled semi-truck, causing part of the truck’s load to come free. As the barrier slid off the truck, it landed on top of the BMW.

Another semi-truck was the fourth vehicle to become involved in the accident, when it was unable to stop in time to avoid colliding with the concrete barrier that had fallen from the truck.
